Constable Pearson was investigating a report of a fight at the Holly Esso Café in Alberta. Upon completion of his taking statements and speaking with persons at the scene, a native male fitting the description of the perpetrator entered the Café carrying a rifle at his side.

Pearson turned toward the individual who raised the 303 rifle. Pearson tried to grab the weapon but the suspect fired, hitting him in the wrist and stomach.
