Sergeant Kirk was travelling with another officer in a police vehicle at night on Yonge Street outside the town of Newmarket. The police vehicle was sideswiped by an oncoming vehicle and forced into a ditch. On impact in the ditch Sergeant Kirk was thrown from the vehicle and killed.
